A U.S. district judge has allowed Roger Ng’s defense lawyer to raise questions about certain emails between ex-Goldman college Tim Leissner and his current supermodel wife Kimora Lee Simmons.

Roger Ng’s defense lawyer Marc Agnifilo aims to show the jury through his questioning of emails to Kimora Lee Simmons that Tim Leissner is an unreliable witness who is actually a «cunning liar». 

«Our theory is that this is a cunning liar, a rare cunning liar,» Agnifilo said about Leissner. 

«I’m seeking to show this jury he’s just a liar and the only way that the jury understands what he’s done with our client and the lengths he’s gone to do other things of an unusual and cunning nature.»

False Representation

According to Agnifilo, Leissner created fake email addresses to falsely act as his second wife Judy Chan and communicant with Simmons, who he was dating at the time. 

Leissner also used Chan’s name in 2016 to purchase art that Malaysian fugitive Jho Low obtained from looting 1MDB.

Email Compromise

U.S. district judge Margo Brodie’s decision marks a compromise compared to the original ruling that the jury couldn’t review the emails after the prosecutor argued that the emails were not relevant as they were sent after the alleged 1MDB scandal and might cause confusion. 

In addition, Brodie said she would also review some of the other emails between Leissner and Simmons to determine if they could be used for trial.
